By downloading, installing, or using the Rock-i mobile application ("App"), you agree to be bound by these Terms and Conditions and our Privacy Policy ("Agreement"). If you do not agree, please uninstall the App.

This Agreement is between you ("User", "you") and Rock-i ("Company", "we", "us"). By using our App, you confirm that you are at least 18 years old or have parental/guardian consent to use the App and the connected e-scooter.

The Rock-i App provides functionality to:

• Connect to and control Rock-i e-scooters via Bluetooth
• Monitor scooter status including battery level, speed, and mileage
• Configure scooter settings and preferences
• Secure your scooter with PIN protection
• Track location and navigation features
• Receive notifications and announcements

The App requires an active Bluetooth connection to communicate with compatible Rock-i e-scooter models.

• Safety First: You are solely responsible for operating the e-scooter safely and in compliance with all local laws and regulations.
• Protective Gear: We strongly recommend wearing a helmet and appropriate protective gear while riding.
• Traffic Laws: You must obey all traffic laws, signals, and signs.
• Age Requirements: You must meet the minimum age requirement set by local laws to operate an e-scooter.
• Physical Condition: Do not operate the e-scooter if you are under the influence of substances that may impair your ability to ride safely.
• Weather Conditions: Avoid riding in adverse weather conditions including rain, snow, or ice.
• Inspection: Before each use, inspect the scooter for any damage. Do not use a damaged scooter.
• Passenger Prohibition: E-scooters are designed for single riders only.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Company shall not be liable for any direct, indirect, or consequential damages arising from your use of the App or e-scooter.
• The Company is not responsible for any injury, death, or property damage resulting from the use or misuse of the e-scooter.
• The App is provided "AS IS" without warranties of any kind.
• You assume all risks associated with operating an e-scooter.

In accordance with Law 09-08 on the protection of individuals with regard to the processing of personal data, we collect and process the following data to provide our services:

• Account Information: Email address and authentication credentials.
• Device & Connection Data: Serial number, MAC address, and connection status of your e-scooter.
• Usage & Diagnostic Data: Speed, odometer, battery levels, and fault codes. These are synced to our secure cloud servers.
• Location Data: GPS coordinates for navigation and tracking features.
• AI Support: Diagnostic data and help requests may be processed by artificial intelligence services to assist you.
• Remote Management: The Company reserves the right to remotely manage certain functions (such as locking/unlocking) to enforce security protocols.

• You are responsible for maintaining the confidentiality of your account credentials and PIN.
• You must immediately notify us of any unauthorized use of your account.
• The Company is not liable for any loss arising from unauthorized access to your account.

• The App, including all content and features, is owned by Rock-i and is protected by intellectual property laws.
• You may not copy, modify, distribute, or sell any part of our App without prior written consent.

• We reserve the right to modify these terms at any time. Continued use of the App constitutes acceptance of the new terms.
• We may suspend or terminate your access to the App at any time for violation of these terms.

You agree to indemnify and hold harmless Rock-i and its agents from any claims, damages, or losses arising from your use of the App or e-scooter, or your violation of these terms.

This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes shall be resolved through competent courts in Morocco.

In accordance with Law 09-08 and CNDP regulations, you have the following rights regarding your personal data:

• Right of Access: You may request a copy of all personal data we hold about you.
• Right of Rectification: You may request correction of any inaccurate or incomplete data.
• Right of Opposition: You may object to the processing of your data for legitimate reasons.
• Right of Deletion: You may request the deletion of your personal data, subject to legal retention requirements.

We retain your personal data only as long as necessary for the purposes described in this policy:

• Account data: Retained while your account is active, deleted within 30 days of account closure.
• Ride and usage data: Retained for 12 months for service improvement, then anonymized.
• GPS location traces: Automatically purged after 90 days.
• Diagnostic logs: Retained for 6 months.

You may request early deletion at any time by contacting privacy@rock-i.com.

The data controller is Rock-i, registered under Moroccan law.

This data processing is declared to the Commission Nationale de contrôle de la protection des Données à caractère Personnel (CNDP) in accordance with Law 09-08.

• حق الوصول: يمكنك طلب نسخة من جميع بياناتك الشخصية.
• حق التصحيح: يمكنك طلب تصحيح أي بيانات غير دقيقة.
• حق الاعتراض: يمكنك الاعتراض على معالجة بياناتك.
• حق الحذف: يمكنك طلب حذف بياناتك الشخصية.

• بيانات الحساب: يتم الاحتفاظ بها أثناء نشاط حسابك، وتُحذف خلال 30 يومًا من إغلاق الحساب.
• بيانات الاستخدام: 12 شهرًا ثم تُجعل مجهولة.
• تتبع GPS: يُحذف تلقائيًا بعد 90 يومًا.
• سجلات التشخيص: 6 أشهر.
